Buying a Beachfront Hotel in Costa Rica: What International Investors Need to Know

Buying a beachfront hotel in Costa Rica can combine a hospitality business with a strategic real estate investment. For international buyers, however, the most important questions go beyond the ocean view: What exactly is owned, which permits apply, how does the hotel earn money, and what improvements are legally and financially feasible?

1. Can Foreigners Buy Hotels in Costa Rica?

Foreign individuals and companies can generally acquire privately titled real estate in Costa Rica, subject to applicable laws and transaction requirements. Buyers should not assume that every beachfront parcel is privately titled, however. Coastal properties may involve maritime-zone concessions or other restrictions, and ownership structure and eligibility can be materially different.

Engage an independent Costa Rican real estate attorney and a qualified notary before making a binding commitment. They should verify the property’s legal status, corporate ownership where relevant, liens, registered boundaries, taxes, and any restrictions on transfer or use.

2. Titled Beachfront Property Versus Maritime-Zone Concessions

One of the first due-diligence questions is whether the land is fully titled or subject to a concession regime. Costa Rica’s maritime-zone framework commonly includes a public zone and a restricted zone, with important exceptions and site-specific rules. A concession is not equivalent to unrestricted fee-simple ownership.

Ask your attorney to review the National Registry record, cadastral survey, shoreline and coastal-zone status, concession documents if applicable, and municipal land-use information. Do not rely on advertising descriptions alone. (For a deeper look, see our guide to titled beachfront versus maritime-zone concessions.)

3. Evaluate the Business, Not Just the Land

A hotel purchase typically involves both real estate and an operating business. Review at least three years of financial statements where available, with clear separation of room revenue, restaurant and bar operations, spa, events, excursions, and transportation.

Important performance indicators include occupancy, average daily rate (ADR), revenue per available room (RevPAR), operating expenses, EBITDA or net operating income, seasonality, and the cost of deferred maintenance. Distinguish verified historical results from seller estimates and future projections.

4. Verify Permits, Water, Utilities, and Environmental Requirements

For a beachfront resort, reliable water supply, wastewater treatment, environmental compliance, fire safety, operating licenses, and lawful access are essential. Ask for documentation supporting well permits and extraction rights, water quality, utility capacity, wastewater systems, and existing construction approvals.

Renovations, additional rooms, residential units, or changes of use may require separate zoning, environmental, engineering, water, and municipal approvals. A visually appealing concept is not evidence that a project has been approved.

5. Understand the Real Costs of Acquiring and Operating a Hotel

Budget for more than the purchase price. Potential costs include legal and notarial services, transfer taxes and registration, accounting and tax advice, insurance, property taxes, staffing, utility systems, working capital, equipment replacement, and capital improvements. Actual transaction costs depend on the structure and facts of the acquisition.

Buyers should also assess labor obligations, existing contracts, supplier relationships, intellectual property, online booking accounts, and whether permits and operating arrangements can continue following a change in ownership.

6. Why Jaco Beach Deserves a Closer Look

Jaco Beach is an established Central Pacific tourism destination with surfing, restaurants, adventure activities, access to the Los Sueños Marina area, and proximity to attractions such as Carara National Park. Its variety of guest segments may offer opportunities for leisure stays, weddings, private group buyouts, and corporate retreats.

Demand is not guaranteed. Investors should test actual hotel performance against seasonality, competitive supply, distribution costs, and achievable room rates.

7. Featured Opportunity: Jaco Laguna Resort

Jaco Laguna Resort is being marketed as a beachfront hospitality investment in Jaco, Puntarenas, with an indicative asking price of US$11,500,000. The offering describes approximately 1.25 acres of titled beachfront land, 30 guest rooms plus one apartment, and eight integrated hospitality revenue centers.

Its marketing materials also report an on-site private well producing approximately 10 liters per second. All property, financial, water-right, and legal claims require independent verification.

The resort’s potential investment approaches include continuing current operations, renovating and repositioning the property, evaluating a hospitality brand affiliation, or investigating redevelopment. None of these possibilities should be interpreted as approved construction plans or guaranteed investment returns.

9. How to Approach an International Hotel Acquisition

Start with a written investment thesis and a realistic capital budget. Request an information package, sign an appropriate confidentiality agreement if needed, and assess the property with your professional team before negotiating definitive terms. An acquisition structure should be chosen with legal and tax advisers based on the specific asset, business, and parties involved.

For international buyers, a disciplined process can be more valuable than rushing toward an attractive listing. The goal is to understand what you are buying, what it costs to operate, and which improvements are genuinely feasible.
